    Following Photo Scraping Allegations, Clearview AI to settle Lawsuit by Providing 23% Stake to Plaintiffs

    New York based facial recognition startup, Clearview AI, has decided to settle a lawsuit it was involved in for scraping the photos of multiple individuals from the internet without their consent or knowledge. The company has offered the plaintiffs a 23 percent stake collectively, as reported by the New York Times on June 13, 2024.

    What is the Lawsuit against Clearview AI about?

    The lawsuit against Clearview AI stems from a 2020 New York Times article which reported about the company using their facial recognition technology to find images of people from the internet, including social networking sites such as Facebook and LinkedIn, along with links to where their photos appeared, which they then shared with law enforcement agencies ranging from the local police to the Federal Bureau of Investigation(FBI).

    Clearview was found to have provided facial data to numerous private and government entities, including the police forces of 27 countries such as the US, India and Saudi Arabia. This resulted in multiple citizens filing lawsuits against the company, eventually consolidated into a single class action case in Illinois, in which lawyers representing the plaintiffs filed for a settlement order in June 2024 that went unopposed by the defendant Clearview.

    Details about the Proposed Settlement

    The proposed settlement, which was reached by lawyers representing both sides, involves providing the entire class, comprising everybody whose data was scraped – in effect a large number of US citizens – with a collective 23% stake in the company, amounting to approximately $52 million. If the company goes public or is acquired, the class could claim a percentage of the proceeds, or alternatively opt for 17% of the company’s revenue after a period of two years.

    Previous Legal Allegations faced by Clearview

    Earlier, Clearview AI was involved in a lawsuit filed by the American Civil Liberties Union in May 2024, for capturing more than three billion faceprints of Illinois residents without their knowledge, which ACLU claimed was in violation of the Illinois Biometric Information Privacy Act, 2008, which requires companies to obtain written permission from subjects before collecting their biometric data.
